Delivering the notice

Did the Tribunal accept your application? Then it is now time to let the other parties know by delivering a notice to them. This notice will include instructions for them to join the case and begin the dispute resolution process.

Download the notice

You will receive an email confirmation once the Tribunal has reviewed and accepted your application. You should then access your case through our online dispute resolution system and download the notices you need to deliver.

You will need to deliver several unique notices if your case has more than one respondent or if it includes an intervenor. Make sure that you download each notice separately and deliver them only to their corresponding party.


Deliver the notice

You must mail or personally deliver a notice you have downloaded to another party.

Here’s how you can deliver the notice yourself:

 

If the recipient is a condo corporation, you must:

  • Personally deliver it to:
    • Someone from your condo’s board of directors
    • Your condo manager
  • Mail it to:
    • The condo’s address for service, as shown in the CAO’s Condo Registry
    • The address for service for the condo’s manager or management service provider, as shown in the CAO’s Condo Registry.

If the recipient is a unit owner, you must:

  • Personally deliver it to:
    • The unit owner
    • Someone over 18 who lives in the unit and confirms the unit owner also lives there
  • Mail it to:
    • The address for service for the unit owner, as shown in the condo’s record of owners and mortgagees
    • The unit’s address, if there is no address for service listed in the condo’s record of owners and mortgagees

If the recipient resides in the unit but does not own it, you must:

  • Personally hand it over to the resident
  • Mail it to the unit’s address via regular mail

The CAT’s online dispute resolution system will automatically send a notice to the parties if you provide an email address for them. They can join the case using that email. Parties may not always do this, so we recommend you deliver the notice yourself as soon as possible and inform the Tribunal you have done so.


Tell the CAT how you delivered the notice

After you have delivered the notice, you must log back into your case and confirm how and when you delivered it. You can do this by clicking on the “Confirm Delivery” button.

The case will automatically move into Stage 1 – Negotiation once everyone joins the case.

You will receive an email notification with instructions on what to do next if someone doesn’t join the case.
