After a public consultation process, the Condominium Authority of Ontario (CAO) has now set its fees. Overall responses to the proposed fee amounts were positive and the CAO has carefully considered all feedback provided.

Fee amounts for the annual Assessments to condo corporations have been confirmed, and for each of the three stages within the Condominium Authority Tribunal, as set out below.


CAO assessments

All condominium corporations are required to pay annual assessment fees to the CAO. The fee has been calculated based on the equivalent of $1 per voting unit per month. According to section 1.30 (5) of the Condominium Act, 1998, the total assessment fee for each condo corporation is to be added to the common expenses. Accordingly, individual condo owners are to be charged based on the percentage that they contribute to the common expenses as set out in the condo corporation’s declaration.

Condominium Authority Tribunal fees

The CAO is responsible for administering the Condominium Authority Tribunal (CAT), a new dispute-resolution forum which will provide condo owners and corporations with fast, fair, and cost-effective online dispute resolution. The CAT will have exclusive jurisdiction to resolve certain dispute types prescribed in regulations to the Condominium Act, 1998.

Stage 1 – Guided Negotiation fee ($25):

  • Provides access the first stage of the CAT’s online dispute resolution services, where parties will be directed to a guided negotiation process. If the issue is not resolved through negotiation, the system will guide the parties to stage 2 of the process.

Stage 2 – Assisted resolution fee ($50):

  • Provides the parties with a CAT member who will assist the parties to try to resolve the dispute collaboratively. If the issue is not resolved through assisted resolution, the system will guide the parties to stage 3 of the process.

Stage 3 – Tribunal decision fee ($125):

  • Provides the parties with a CAT member who will conduct a formal adjudication of the issues in dispute, consider the evidence of the parties, and issue a binding order.

The total cost, should the dispute require the services of an adjudicator, will be $200.

These fees will be paid by the party who files the dispute, and are not refundable. Please note that the CAT has the authority to order one party to pay the costs incurred by another party, including costs related to any of the above CAT fees, if appropriate.
