Can condo boards restrict short-term rentals?
Yes, condo corporations can restrict short-term rentals by including a provision within their governing documents.
Why do some corporations restrict short-term rentals?
Short-term rentals may lead to disruptions in condo communities if occupants do not comply with the condo’s rules, municipal by-laws or other laws. Some issues that may arise, include:
- Security concerns because of additional keys or fobs in circulation
- Additional wear and tear caused by increased use of common elements or amenities
- Tenants or their guests disrupting the condo community or failing to comply with the condo’s governing documents
Can I bring a short-term rental issue to the CAT?
The Condominium Authority Tribunal can only deal with short-term rental issues if:
- The condo corporation’s governing documents prohibit, restrict or govern short-term rentals
- The short-term rental is causing a nuisance, annoyance or disruption involving noise, odour, light, vibration, smoke or vapour.
The CAT cannot deal with disputes involving dangerous situations that may cause injury, illness or damage to a condo units or common elements.
