La Loi sur les condos \u00e9nonce les <a href=\"https:\/\/www.condoauthorityontario.ca\/fr\/before-you-buy-or-rent\/fees-and-finances\/chargebacks-fr\/\">raisons pr\u00e9cises<\/a> pour lesquelles les associations condominiales peuvent percevoir ces r\u00e9trofacturations, mais les associations peuvent en autoriser d&#8217;autres types dans leur d\u00e9claration. Les r\u00e9trofacturations sont l&#8217;un des principaux outils dont disposent les associations condominiales pour faire respecter la conformit\u00e9 avec leurs documents constitutifs. \u00a0<\/span><\/p>\n<p><span class=\"cao-paragraph cao-std-body-copy\">Les associations condominiales devraient communiquer souvent et de mani\u00e8re proactive avec les propri\u00e9taires qui risquent d&#8217;engager des frais et elles ne devraient pas syst\u00e9matiquement recourir \u00e0 une r\u00e9trofacturation comme premi\u00e8re mesure. Les propri\u00e9taires peuvent contester les r\u00e9trofacturations devant le Tribunal de l\u2019autorit\u00e9 du secteur des condominiums ou les tribunaux, selon le type de r\u00e9trofacturation. L&#8217;association condominiale peut enregistrer un privil\u00e8ge sur la partie privative des propri\u00e9taires qui refusent de payer.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h4>Les propri\u00e9taires sont-ils responsables des dommages caus\u00e9s par leurs locataires ou leurs invit\u00e9s?<\/h4>\n<p><span class=\"cao-paragraph cao-std-body-copy\">Oui, les propri\u00e9taires sont responsables des dommages caus\u00e9s par leurs locataires, leurs invit\u00e9s ou d&#8217;autres occupants.
